An independent panel of experts in charge by the United Nations Human Rights Council has concluded “for reasonable reasons that Israeli authorities and Israeli security forces have committed and continue to commit” acts of genocide against the Palestinians in Gaza.
In its report published on Tuesday, the Independent International Research Commission on the occupied Palestinian territory, including East Jerusalem, and Israel, which was established by the HRC in 2021, said it had compiled and analyzed evidence in relation to alleged violations of human rights committed by all parties in the parties in the parties in the parties in the parties in the parties in the parties in the parties in the parties in the parties in the parties in the parties in the parties in the parties in the parties in the parties in the parties in the parties in the parties in the parties in the parts in the parts in the parts in the parts in the parts in the parts in the parts in the parts in the parts in the parts in the parts in the parts in the parts in the parts in the parts in the parts in the parts in the parts in the parts in the parts in the parts in the parts in the parts in the parts in the parts in the parts in the parts in the parts in the parts in the parts in the parts in the parts in the parts in the parts in the parts in the Israel-Hamas Warthat Israel launched in response to the terrorist attack of October 7 of Hamas.
“Today, we are witnesses in real time how the promise of ‘Never again’ is broken and proven in the eyes of the world. The in progress in Gaza is a moral outrage and a legal emergency,” said Navi Pillay, president of the commission, in an informative news session on Tuesday. “It is not necessary to wait for the International Court of Justice to declare a genocide. All states are obliged to use any means within their power to avoid the genocide commission. Therefore, we urge member states to guarantee the responsibility of any crime that has committed and avoid that more crimes are committed, not only in Gaza, but throughout the territory of Palestinian Territory.”
Israel Foreign Minister Gideon Saar described the report as “false.”
“The report is completely based on the falsehoods of Hamas, washed and repeated by others,” said Saar, echoing the language used in statements of the Israeli government that respond to accusations that he is committing genocide. “In marked contrast to lies in the report, Hamas is the party that tried the genocide in Israel: to kill 1,200 people, violate women, burn families alive and openly declare their goal of killing all Jews.”
Genocide is defined under international law as the commission of certain acts against a group “with the intention of destroying, in its entirety or part, a national, ethnic, racial or religious group.”
These acts include “causing serious bodily or mental damage to the group members; deliberately inflict the conditions of the life group calculated to achieve their physical destruction in its entirety or partly; imposing measures aimed at preventing births within the group” and “transfer to the children of the group to another group”.

In his report, the commission said that the Israeli authorities and security forces have committed and continue to commit the following actus reus of genocide against the Palestinians in the Gaza Strip, namely (i) to the members of the life of life, (ii) that cause life in the group of life of life. Impose measures aimed at preventing births within the group. “
The commission also said that the statements made by the Israeli authorities have demonstrated “direct evidence of genocidal intention”, and that, together with the circumstantial evidence of similar intention, “the Israeli authorities and the Israeli security forces have had and continue to have the genocidal intention of destroying, in full or part, the Palestinians in the strip of Gaza.”
Based on its analysis, the commission said that Israeli Prime Minister Benjamin Netanyahu, President Isaac Herzog and defense minister Yoav Gallant, “prompted the genocide commission and that the Israeli authorities have not taken measures against them to punish incitement.”

“The Commission concludes that the State of Israel has responsibility for not preventing genocide, the genocide commission and the lack of punishment for genocide against the Palestinians in the Gaza Strip,” the report said.
“The Commission has not fully evaluated the statements of other Israeli political and military leaders, including the Minister of National Security. Itar Ben-Gvir and Finance Minister Bezalel SmotrichAnd consider that they should also be evaluated to determine if they constitute incitement to commit genocide, “the commission added.
The report says that Israel should “immediately end the genocide commission in the Gaza Strip” and implement a permanent fire, allowing the free flow of humanitarian aid in the Palestinian territory. He also asked other UN Member States to “use all means reasonably available to avoid the genocide commission in the Gaza Strip”, including the arrest of weapons transfer and other equipment to Israel.
Several academics and international and Israeli human rights groups had previously accused Israel of committing genocide against the Palestinians in Gaza.
In August, the International Association of Genocide Academics, a group of academics specialized in the subject, declared in a resolution That Israel’s actions in Gaza since the 22 -month war began constitutes genocide, war crimes and crimes against humanity. The group in turn has faced strong criticism of Israeli officials and Jewish groups about the way they operate and acquire members, although since then they have suspended their membership system in response to what they call a “spam and harassment campaign.”
In July, the Israeli Rights Group B zelem and the Organization of Doctors for Human Rights accused Israel of committing genocide against the Palestinians in Gaza.
The International Court of Justice is also listening A casebrought by the Government of South Africa, which accuses Israeli forces of committing genocide.
Israel has dismissed all statements, insisting that they are “biased and false” and are based on the misinformation spread by Hamas.
