A student at the University of Tufts of Turkey who is being held in Louisiana must be returned to New England before May 1 to determine if it was illegally detained by immigration officials to co-write an opinion article in the student newspaper, a federal judge ruled on Friday.

The United States District Judge, William Sessions in Burlington, Vermont, said he would listen to Rumea Ozturb’s request from being released from detention. His lawyers had requested to release her immediately, or at least they will bring him back to Vermont.

“The Court concludes that this case will continue in this court with Mrs. Ozturb physically present during the rest of the procedure,” the judge wrote. “Mrs. Ozturb has presented claims of viable and serious habit that justify an urgent review of the merits. The court plans to move quickly to a bail hearing and the final disposal of the habeas request, since the claims of Mrs. Ozturk do not require no less.”

Immigration officials surrounded the 30 -year -old doctoral student while walking down a street in a Boston suburb on March 25 and took her to New Hampshire and Vermont before putting her on a plane to a detention center in Basile, Louisiana. An immigration judge denied his bail request on Wednesday, citing “danger and risk of escape” as justification.

OzTurb is among several people with ties with American universities whose visas were revoked or have been prevented from entering the United States after they were accused of attending demonstrations or publicly expressing their support for the Palestinians. An immigration judge of Louisiana ruled that the United States can deport the graduate student from Columbia University, Mahmoud Khalil, based on the federal government argument that represents a national security risk.

A lawyer from the Department of Justice said his case must be dismissed, saying that the Immigration Court has jurisdiction.

Ozturb’s lawyers presented a request for the first time in their name in Massachusetts. Initially, they didn’t know where I was. They said they could not talk to her until more than 24 hours after she was arrested. Ozturb herself said without success made multiple requests to talk to a lawyer.

Ozturb was one of the four students who wrote an opinion article in the Campus newspaper, the Tufts newspaper, last year, criticizing the university’s response to student activists who demand that TUFTS “recognize the Palestinian genocide”, reveals its investments and disinfle companies with links to Israel.

Ozturb’s lawyers say their detention violates their constitutional rights, including freedom of expression and due process.
