The New York Times reporter, Maggie Hasman, says that the administration of President Donald Trump has “undermined his own case” that they would have to suspend the habeas corpus due to an alleged invasion of immigrants, since they have sealed the border between the United States and Mexico.

Consecrated in the Constitution, the Habeas Corpus protects people from illegal detention with the right to appear in front of a judge. Trump’s main advisor Stephen Miller said Friday that “it can be suspended at a time of invasion”, and that doing so is “an option” that they are “actively looking.”

Haberman destroyed the idea during an appearance on Friday in “The Source” of CNN.

“I don’t think any court has agreed that the United States is under invasion,” Kaitlan Collins told host. “This is how it has been used in the past to suspend habeas corpus, regionally. And when Abraham Lincoln did it, he was actually quite controversial, number one.”

“Number two,” said Haberman, is “this would absolutely be challenged.”

“I don’t know what you would call it: just for migrants,” he continued. “And the border is sealed, so they have really undermined their own case, in many ways. I think they have some running room, politically, but they can run out of him at some point.”

Trump launched mass deportations shortly after assuming office earlier this year and declared a national emergency on the southern border. Since then he has invoked Alien enemies law of 1798 to accelerate deportations, only to be hindered by the courts.

Haberman pointed out on Friday that several judges already said that the administration is “reading badly” the law of war they have invoked for deportations, and that Trump’s success in closing the border will be his greatest obstacle when trying to suspend habeas corpus.

“They did almost immediately when they entered,” Haberman told Collins about the closure of the border. “They were almost too fast for their own good, because they have now continued trying to do other things and continue to step on their own success.”

The National Security Department said Monday that people who are in the United States will illegally receive $ 1,000 if they deport voluntarily. As for a possible suspension of habeas corpus, Haberman hopes that, in the worst case, it is simply a fear tactic.

“Some of this could be fear,” he said Friday. “A, is a way to intimidate the courts, which we have seen Trump and Stephen Miller do a lot. They have criticized the judges routinely and repeated. It could also be scared migrants and make migrants leave.”
